Welcome to BabyBloom! These Terms & Conditions ("Terms") govern your use of the BabyBloom mobile application ("App") and the website at getbabybloom.com ("Website"), collectively referred to as the "Service." The Service is operated by Carelion Tech LLC ("we," "us," or "our").

By downloading, installing, or using BabyBloom, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

BabyBloom is a free iOS fertility companion app designed to help you track menstrual cycles, medications, appointments, and emotional wellness throughout your fertility journey. The App also provides health and wellness educational content through the App and our online journal. Your personal data is stored locally on your device.

3. User Eligibility

You must be at least 18 years of age to use the Service. By using BabyBloom, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

BabyBloom is designed for informational, organizational, and emotional support purposes only. The Service does not provide medical advice, diagnosis, or treatment. Nothing in the App or on the Website should be construed as professional medical advice or a substitute for consultation with a qualified healthcare provider.

You should always seek the advice of your physician, reproductive endocrinologist, or other qualified health provider with any questions regarding a medical condition, fertility treatment, medication, or health concern. Never disregard professional medical advice or delay seeking it because of something you have read or tracked in BabyBloom.

5. Account and Usage Responsibilities

You are responsible for your use of the Service. You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or disassemble the App
• Interfere with or disrupt the Service or its servers
• Use the Service to transmit malware, viruses, or harmful code
• Reproduce, distribute, or create derivative works from the Service
• Use automated tools to scrape or access the Service

You are responsible for maintaining the security of your device and any data stored within the App.

6. Intellectual Property

All content, features, functionality, design, text, graphics, logos, and software within the Service are owned by Carelion Tech LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our prior written consent.

The BabyBloom name, logo, and all related marks are trademarks of Carelion Tech LLC.

7. User-Generated Content

If the Service allows you to submit, post, or share content (such as journal entries, notes, or feedback), you retain ownership of that content. However, by submitting content to us (for example, through feedback or support requests), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for the purpose of operating and improving the Service.

You are solely responsible for any content you submit and represent that it does not violate any third party's rights.

8. Privacy

Your privacy matters to us. Please review our Privacy Policy, which explains how we handle your information. BabyBloom is designed with privacy in mind - your personal health data is stored locally on your device. By using the Service, you also agree to the terms of our Privacy Policy.

9. Disclaimer of Warranties

The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or reliability of any content, information, or data provided through the Service - including any health-related content.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Carelion Tech LLC, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages - including but not limited to loss of data, loss of profits, personal injury, or damages arising from your use of or inability to use the Service.

In no event shall our total liability to you exceed the amount you paid us in the twelve (12) months prior to the claim, or fifty dollars ($50), whichever is greater.

This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless Carelion Tech LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit through the Service.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time by deleting the App from your device.

Upon termination, all provisions of these Terms that by their nature should survive will remain in effect, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this page and may notify you through the App or Website. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

15. Third-Party Links & Services

The Service may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party sites or services. We encourage you to review the terms and privacy policies of any third-party sites you visit.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and Carelion Tech LLC regarding the Service, and supersede any prior agreements or understandings.
